Newsletter terms and conditions

INTRODUCTION

  1. The owner of the practice is Anna Báthory, operating as a sole proprietorship under the business name ANNA BÁTHORY PSYCHOTERAPIA SZKOLENIA COACHING, registered in the Central Register and Information of Economic Activity of Poland (CEIDG), under Tax Identification Number (NIP): 6782551489, with its principal place of business at Jozefa Sarego Street No. 12, Unit 14 31-047 Cracow (ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków), Poland, email: office@annabathory.pl, phone: + 48 501 19 20 48.
  2. Through the Website and its subpages, Anna Báthory provides electronic services, including the Newsletter service, and enables users to enter into an agreement for the supply of digital content, under which payment is made in exchange for personal data. The Newsletter Terms and Conditions also apply to all websites or services that include a reference to them.

DEFINITIONS

  1.  Newsletter Subscription Form – an interactive form available on the Website provided by Anna Báthory, enabling users to subscribe to the Newsletter service.
  2.  Newsletter – an electronic service provided by Anna Báthory to a user who has actively subscribed to the mailing list via the Newsletter subscription form available on the Website. As part of the service, Digital materials are delivered.
  3.  Digital materials – data created and delivered exclusively in digital form, including in particular, information provided in exchange for subscribing to the Newsletter or data created or delivered in the course of providing the Newsletter service; digital content within the meaning of Article 2(5) of the Polish Act on Consumer Rights.
  4.  Subscriber – a user who has expressed the intention to use the Newsletter service and has consented to receiving messages via e-mail communication at the e-mail address provided by the user.
  5.  Payment with Data – the provision of the user’s personal data in exchange for the delivery of Digital Materials.
  6.  Price – a value expressed in monetary units which the user is obliged to pay to Anna Báthory for a product or service, and, in the case of a digital product, also a digital representation of the value; Price within the meaning of Article 2(5) of the Polish Act on Consumer Rights.
  7.  Newsletter Terms and Conditions – this document.
  8.  Website – the website available at https://annabathory.pl/ and its subpages.
  9.  User – ​​Any natural person visiting the Website who intends to use the Newsletter service. The Website is not intended for children. The User must be at least 18 years old. Anna Báthory is entitled to take actions to verify the User’s age.
  10. Order – 2.1.a declaration of intent submitted by the User via the Website, another dedicated interface, or by e-mail, intended to enter into an agreement on the terms set out in the Website Terms and Conditions.

The terms defined in this Section are provided solely for convenience and ease of reference. These terms may be used in the singular or plural form and may be capitalized or not, without affecting their meaning.

GENERAL TERMS AND CONDITIONS OF USING THE SERVICE 

  1. The Newsletter Terms and Conditions set out the rules for using the Newsletter service; the manner of concluding and terminating agreements for the supply of digital content, under which payment is made by personal data or by payment of a price; the terms of delivery; and the complaint-handling procedure.
  2. The rules governing the use of electronic services other than the Newsletter are set forth in the Website Terms and Conditions.
  3. For the purposes of the Newsletter Terms and Conditions, Anna Báthory provides the following contact details:

  1. Information provided on the Website regarding the Newsletter service does not constitute an offer within the meaning of the Polish Civil Code, but constitutes solely an invitation to enter into an agreement within the meaning of Article 71 of the Polish Civil Code.
  2. Prior to commencing use of the Website, Anna Báthory makes the Newsletter Terms and Conditions available to the User free of charge at the bottom of the Website and each time together with the Newsletter subscription form. The content of the Newsletter Terms and Conditions is made available in a manner enabling the User to record and reproduce it at any time by downloading it, saving it, or printing it.

TECHNICAL REQUIREMENTS

  1. The User may use the Newsletter in a manner consistent with the Newsletter Terms and Conditions and applicable law, and in a manner that does not disrupt the functioning of the Website or the activities of other users.
  2. Use of the Website, including subscription to the Newsletter service, is possible provided that the User meets the following minimum technical requirements:
  • Possession of a device enabling access to the Internet, equipped with a functioning operating system, such as macOS, Android, or Windows;
  • Installation of a current version of an Internet browser supporting HTML5 and providing access to Internet resources, such as Mozilla Firefox, Google Chrome, Safari, or another compatible Internet browser that supports cookies, on the above-mentioned device;
  • Having an active email account.
  1. The use of the Newsletter service and access to Digital Materials require the transmission of data over the Internet, which carries risks inherent in the operation of the Internet network.
  2. To ensure security on the Website, Anna Báthory applies technical, organizational, and legal measures appropriate to the level of security risk, in particular measures intended to prevent unauthorized access to, acquisition of, or modification of personal data transmitted over the Internet by unauthorized persons. Anna Báthory ensures the security of data transmission on the Website by using the TLS protocol.

AGREEMENT FOR THE SUPPLY OF DIGITAL CONTENT

  1.  Anna Báthory enables the User to enter into an agreement for the supply of digital content.
  2.  The User enters into an agreement for the supply of digital content under which the User is required either to make Payment with Data or to pay a Price.
  3.  An agreement for the supply of digital content in exchange for Payment with Data is concluded on the terms set out in Section 6 of the Newsletter Terms and Conditions – Newsletter service. 
  4.  An agreement for the supply of digital content in exchange for a Price is concluded on the terms set out in Section 7 of the Newsletter Terms and Conditions – Agreement for the Supply of Digital Content. 

NEWSLETTER SERVICE

  1. Anna Báthory provides the Newsletter service consisting of the transmission of commercial information, including direct marketing content, to Users subscribed to the mailing list, in particular information concerning blog articles, social media publications, products and services, as well as events or training sessions, by means of e-mail communication.
  2. To begin the Newsletter service and add the email address to the subscriber list, the User is requested to complete the subscription form available on the Website, provide their first name and email address, and confirm the subscription by clicking the “Subscribe and receive your guide” button or an equivalent button. Upon submission of the subscription form, an email message is sent to the email address provided by the User, requesting confirmation of the subscription or requesting deletion of the message if the request was sent in error. The message contains an active link that, when clicked, confirms the subscription. Confirmation of the subscription results in the User being added to the subscriber database.
  3. Confirmation of the subscription indicates that the User consents to the use of automated calling systems and telecommunications terminal equipment to transmit commercial information, including direct marketing, by electronic means. The consent is voluntary; however, it is required to subscribe to the mailing list and receive the Newsletter. Failure to grant such consent will prevent the Newsletter service from being provided. The Subscriber may withdraw consent at any time, which will result in the discontinuation of the Newsletter service. Upon effective subscription to the mailing list, an agreement for the supply of digital content in exchange for payment with data is concluded.
  4. A User wishing to use the Newsletter service must provide true and accurate personal data when completing the subscription form referred to in Section 6.2 and to update such data in the event of any change.
  5. The Newsletter service, including the Digital Materials provided thereunder, is protected by copyright and other proprietary rights held by Anna Báthory.
  6.  The User may terminate the Newsletter service at any time, without providing any reason. Resignation may be submitted:
  • In electronic form, via an active link included each time in the footer of every message sent as part of the Newsletter service, marked as “Unsubscribe” or with a similar designation;  
  • In electronic form, by sending a message to the e-mail address: office@annabathory.pl; 
  • In written form, by sending a notice to the postal address: Anna Báthory Psychoterapia Szkolenia Coaching, ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków, Poland.
  1. Use of the unsubscribe link in the Newsletter service, or submission of a request to resign from the service by e-mail or traditional mail, shall result in the immediate termination of the agreement for the provision of the Newsletter service.
  2. Anna Báthory reserves the right to discontinue the Newsletter service at any time. Any discontinuation of the Newsletter service shall be communicated to the User via the e-mail address provided during the Newsletter subscription process. 

 AGREEMENT FOR THE SUPPLY OF DIGITAL CONTENT IN EXCHANGE FOR A PRICE

  1. A User who does not wish to enter into an agreement for the supply of digital content in exchange for Payment with Data may enter into an agreement for the supply of digital content in exchange for a Price. 
  2. The User purchases Digital Materials in exchange for a Price by placing an Order by sending a message to the e-mail address office@annabathory.pl.
  3. To place an Order, the User must provide the data required to process the Order, namely: first and last name, postal address, e-mail address, and, in the case of an entrepreneur or an entrepreneur to whom the provisions of the Polish Act on Consumer Rights apply, the business name and tax identification number (NIP).
  4. In response to the submitted Order, Anna Báthory shall either present the sales terms and conditions or provide a dedicated interface to finalise the Order.

COMPLAINTS

  1. In the event of any objections to the Newsletter service or the operation of the Website, the User may submit a complaint:
  • In written form, by sending it to the postal address: Anna Báthory Psychoterapia Szkolenia Coaching, ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków.
  • In electronic form, by sending it to the e-mail address: office@annabathory.pl.
  1. It is recommended that the complaint description include information and circumstances related to the subject matter of the complaint, particularly the type and date of the alleged issue, as well as the specific request made by the Visitor. Providing this information is optional and does not affect the validity of a complaint submitted without it. Providing contact details is necessary to process the complaint and provide a response.
  2. All complaints shall be reviewed without undue delay and no later than 14 days from the date of receipt of the complaint. The Visitor submitting the complaint shall receive a response by email sent to the email address from which the complaint was submitted, or in writing to the mailing address indicated in the written correspondence.
  3.  A Consumer has the following options:
  • to apply to a permanent consumer arbitration court to resolve a dispute arising from a concluded agreement;
  • to apply to the Inspector of the Polish Trade Inspection to initiate mediation proceedings to amicably settle a dispute between the Consumer and Anna Báthory;
  • to seek assistance from a district (municipal) consumer ombudsman or a consumer protection organization whose statutory tasks include consumer protection, such as the Polish Consumer Federation or the Polish Consumers’ Association.

MODIFICATION OF THE NEWSLETTER TERMS AND CONDITIONS

  1. Anna Báthory reserves the right, to the extent permitted by applicable law, to amend the Newsletter Terms and Conditions.
  2. Anna Báthory is entitled to unilaterally amend the Newsletter Terms and Conditions with respect to provisions that have not been individually agreed with the User, provided that such amendments are justified. Justified reasons include, in particular:
  • Changes in applicable laws in force within the territory of the Republic of Poland;
  • the need to supplement, clarify, or modify the Newsletter Terms and Conditions to comply with applicable laws in force within the territory of the Republic of Poland or to ensure greater transparency of the Newsletter Terms and Conditions;
  • The issuance by public administrative authorities of a decision that modifies the content of the Newsletter Terms and Conditions or imposes an obligation to introduce specific amendments thereto;
  • The introduction of new functionalities on the Website or modification of the existing scope of such functionalities;
  • The introduction of new IT systems or the modification of existing IT systems;
  • The development of judicial or administrative case law indicates that the content of the Newsletter Terms and Conditions is inconsistent with the law.
  1. Anna Báthory shall inform the User of the proposed amendments to the Newsletter Terms and Conditions by publishing on the Website the content of the proposed amendments, the effective date, and the consolidated text of the Newsletter Terms and Conditions as amended.
  2. Anna Báthory shall also inform the User of the content of the proposed amendments, the date of their entry into force, and the consolidated text of the Newsletter Terms and Conditions as amended via the e-mail address provided during the Newsletter subscription process.
  3. Prior to the amendments to the Newsletter Terms and Conditions take effect, the User may declare that they do not accept the proposed amendments. A declaration of non-acceptance of the amendments to the Newsletter Terms and Conditions shall be deemed equivalent to the User’s resignation from the Newsletter service.
  4. Amendments to the Newsletter Terms and Conditions shall be binding on the User if the User has been duly notified of the amendments and has not terminated the agreement within 14 days of receipt of the notification of the amendments

MISCELLANEOUS

  1. All agreements are concluded in Polish and are governed by Polish substantive and procedural law. The English version of the Terms and Conditions is provided for informational purposes only.
  2. For the avoidance of doubt, nothing in the Terms and Conditions shall limit or exclude any rights of a consumer or an entrepreneur afforded consumer protection under the laws in force in the Republic of Poland. In the event that any provision of the Terms and Conditions is found to have such an effect, the mandatory provisions of applicable law shall prevail.
  3. In matters not regulated by the Newsletter Terms and Conditions, the Website Terms and Conditions, and the applicable provisions of Polish law shall apply.
  4. The Newsletter Terms and Conditions take effect on 1 September 2025.
