Reviews policy
INTRODUCTION
The Reviews Policy sets out the rules for submitting, publishing, and verifying reviews related to the services offered by Anna Báthory, operating as a sole proprietorship under the business name ANNA BÁTHORY PSYCHOTERAPIA SZKOLENIA COACHING, registered in the Central Register and Information of Economic Activity of Poland (CEIDG), under Tax Identification Number (NIP): 6782551489, with its principal place of business at Jozefa Sarego Street No. 12, Unit 14, 31-047 Cracow (ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków), Poland, email: office@annabathory.pl, phone: + 48 501 19 20 48.
DEFINITIONS
- Consumer – a natural person who enters into a legal transaction with Anna Báthory that is not directly related to that person’s business or professional activity.
- Social Media – accounts or profiles on social networking platforms, including:
- Instagram – an account on the Instagram platform named ‘annabathory_psychotherapist‘;
- Facebook – a page on the Facebook platform named ‘Prywatna Praktyka Psychologiczno-Psychoterapeutyczna Anna Báthory’;
- Google Business Profile – a website within the Google My Business service under the name ‘Psychoterapia Szkolenia Coaching Anna Báthory’ and available in Google Search results at: https://share.google/7eFIX34wSxKgCBFb0.
- Review – any subjective statement or part thereof published by Anna Báthory on the Website, the Google Business Profile, Social Media, or the ZnanyLekarz platform.
- Review Policy – this document.
- Service – any service, including digital services, as well as the rights and obligations arising from civil law relationships; a ‘product’ within the meaning of Article 2(3) of the Act on Counteracting Unfair Commercial Practices.
- Website – the website available at https://annabathory.pl/ and its subpages.
- Act on Counteracting Unfair Commercial Practices – the Polish Act of 23 August 2007 on Counteracting Unfair Commercial Practices (Polish Journal of Laws of 2007, items 171 and 1206, as amended).
- Visitor – any natural person visiting the Website, the Google Business Profile, Social Media, or the ZnanyLekarz platform.
- ZnanyLekarz – a profile on an external online platform available at https://www.znanylekarz.pl/anna-bathory/psycholog-psychotraumatolog/krakow, enabling the purchase of a Service and the submission of Reviews.
The terms defined in this Section are provided solely for convenience and ease of reference. These terms may be used in the singular or plural form and may be capitalized or not, without affecting their meaning.
STANDARDS FOR REVIEW PUBLICATION
- Anna Báthory provides access to Reviews related to the Services.
- Only positive or neutral Reviews are published on the Website, the Google Business Profile, and Social Media.
- Published Reviews originate from Customers who have purchased a Service.
- Anna Báthory ensures that Reviews published on the Website, the Google Business Profile, and Social Media are submitted by Consumers who have actually used the relevant Service or purchased it from Anna Báthory.
- Published Reviews are not sponsored and are independent of any contractual relationship between the Customer and Anna Báthory.
REVIEW VERIFICATION PROCEDURE ON THE WEBSITE
- Anna Báthory independently publishes Reviews on the Website.
- All Reviews are verified for compliance with the Reviews Policy prior to publication.
- The verification process consists of confirming whether the Consumer who submitted a Review has actually used the Services.
- For the purpose of verifying Reviews, Anna Báthory undertakes the following actions:
- verification of the reviewer’s details against the data of Customers who have purchased a Service, including, in particular, the reviewer’s first and last name, and email address.
- If, under Section 4.4, Anna Báthory determines that the person who submitted the Review has used the Services, the Review shall be published on the Website in accordance with the terms set forth in this Reviews Policy.
- If, under Section 4.4, Anna Báthory has any remaining doubts about whether the reviewer has used the Services, Anna Báthory may request that the Consumer who submitted the Review provide additional information confirming that the Services were used.
- Only Reviews submitted by Consumers who have used the Services offered by Anna Báthory are eligible for publication.
REVIEW VERIFICATION PROCEDURE ON SOCIAL MEDIA
- Anna Báthory independently publishes Reviews received from Consumers on Instagram.
- All Reviews published on Instagram are verified for compliance with the Reviews Policy prior to publication.
- The review verification rules set forth in Sections 4.3–4.7 shall apply to reviews published on Instagram.
- Anna Báthory permits Visitors to submit Reviews on Facebook in accordance with the platform’s available functionalities.
- The owner’s Facebook does not verify whether Visitors who review or recommend a Service on Facebook have actually purchased or used the Service.
- Reviews on Facebook are posted independently by Visitors.
- All Reviews published on Facebook are promptly verified for compliance with the Reviews Policy. The review verification rules set forth in Sections 4.5–4.7 shall apply to Reviews published on Facebook.
- If, under the procedure set forth in Section 5.7, Anna Báthory is unable to confirm that the Consumer who submitted a Review has used the Services, Anna Báthory shall take all reasonably available steps to remove the Review, including contacting the owner of Facebook and requesting removal of the Review using the platform’s ‘Report post’ functionality. In addition, Anna Báthory shall post a comment under the Review indicating that the Review was not submitted by a Consumer who has used the Services.
REVIEW VERIFICATION PROCEDURE FOR THE GOOGLE BUSINESS PROFILE
- Anna Báthory permits Visitors to submit Reviews on the Google Business Profile in accordance with the available functionalities on that platform.
- Google does not verify whether Visitors who review or recommend Services on the Google Business Profile have actually purchased or used those Services.
- Reviews on the Google Business Profile are posted independently by Visitors.
- All Reviews published on the Google Business Profile are promptly verified for compliance with the Reviews Policy. The review verification rules set forth in Sections 4.5–4.7 shall apply to Reviews published on the Google Business Profile.
- If, under the procedure set forth in Section 6.4, Anna Báthory is unable to confirm that the Consumer who submitted a Review has used the Services, Anna Báthory shall take all reasonably available steps to remove the Review, including contacting Google and requesting removal of the Review using the platform’s ‘Report a policy violation’ functionality. In addition, Anna Báthory shall post a comment under the Review indicating that the Review was not submitted by a Consumer who has used the Services.
REVIEW VERIFICATION PROCEDURE ON ZNANYLEKARZ PLATFORM
- Anna Báthory permits Visitors to submit Reviews on the ZnanyLekarz platform, subject to the platform’s available functionality.
- The ZnanyLekarz platform verifies whether Visitors who review or recommend Services have actually purchased or used those Services.
- Reviews on the ZnanyLekarz platform are published independently by Visitors.
- All Reviews published on the ZnanyLekarz platform are promptly verified for compliance with this Customer Reviews Policy. The review verification rules set forth in Sections 4.5–4.7 shall apply to Reviews published on the ZnanyLekarz platform.
- If, based on the procedure set forth in Section 7.4, Anna Báthory is unable to confirm that the Consumer who submitted a Review used the Services, Anna Báthory shall take all reasonably available steps to remove the Review, including contacting the owner of the ZnanyLekarz platform and requesting removal of the Review using the platform’s ‘Report abuse’ functionality.
PUBLICATION, MODIFICATION, AND REMOVAL OF REVIEWS
- Anna Báthory publishes Reviews in their original, unaltered form, meaning that Reviews are not edited, redacted, shortened, or otherwise modified prior to publication.
- To the fullest extent permitted by applicable law, Anna Báthory reserves the right to modify or remove, in whole or in part, any Review, including after publication, particularly where a Review:
- is unlawful or contrary to generally accepted standards of conduct, including but not limited to content that is offensive, threatening, defamatory, obscene, pornographic, hateful, racist, discriminatory, abusive, slanderous, or that promotes violence;
- infringes or may infringe the rights of third parties, including, without limitation, copyrights, trademarks, other intellectual property rights, or rights of publicity or privacy;
- is false, misleading, or contains false statements of fact;
- contains confidential information or personal data;
- contains harmful technical elements, such as viruses, worms, malware, or other potentially harmful software or files;
- contains embedded links to external websites;
- is required to be removed pursuant to a court judgment or an administrative decision;
- is required to be removed as a result of a cease-and-desist order or other legally binding demand by a third party; or
- relates to a Service that has been discontinued or withdrawn.
COMPLAINTS
- If a Visitor has any objections or concerns regarding Reviews, they may submit a complaint electronically to office@annabathory.pl or in writing to Anna Báthory Psychoterapia Szkolenia Coaching, ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków, Poland.
- It is recommended that the complaint description include information and circumstances related to the subject matter of the complaint, particularly the type and date of the alleged issue, as well as the specific request made by the Visitor. Providing this information is optional and does not affect the validity of a complaint submitted without it. Providing contact details is necessary to process the complaint and provide a response.
- All complaints shall be reviewed without undue delay and no later than 14 days from the date of receipt of the complaint. The Visitor submitting the complaint shall receive a response by email sent to the email address from which the complaint was submitted, or in writing to the mailing address indicated in the written correspondence.
LIABILITY
- Customers are solely responsible for the Reviews they submit.
- Anna Báthory shall not be liable for the content of Reviews submitted by Customers. In particular, Anna Báthory shall not be liable for any damages, losses, or claims asserted by Consumers or third parties arising from or relating to the content of published Reviews.
- Reviews must not violate applicable law or the rights of third parties and, in particular, must not infringe the personal rights, dignity, or legally protected interests of any third party.
MISCELLANEOUS
- Anna Báthory seeks to continuously improve the procedures for verifying published Reviews. Accordingly, the Reviews Policy is reviewed on an ongoing basis and may be amended as necessary.
- Anna Báthory encourages Visitors to review the Reviews Policy regularly to stay informed of any updates.
- The most current version of the Reviews Policy is published on the Website.
- The English version of the Reviews Policy is provided for informational purposes only.
