Practice policy (Counseling agreement)
INTRODUCTION
- The owner of the practice is Anna Báthory, operating as a sole proprietorship under the business name ANNA BÁTHORY PSYCHOTERAPIA SZKOLENIA COACHING, registered in the Central Register and Information of Economic Activity of Poland (CEIDG), under Tax Identification Number (NIP): 6782551489, with its principal place of business at Jozefa Sarego Street No. 12, Unit 14 31-047 Cracow (ul. Józefa Sarego, nr 12, lok. 14, 31-047 Kraków), Poland, email: office@annabathory.pl, phone: + 48 501 19 20 48.
- The Practice Policy define the scope and nature of the services provided by Anna Báthory and the terms under which they are provided.

- The information provided in the Practice Policy does not constitute an offer within the meaning of the applicable civil law and shall be construed solely as an invitation to enter into an agreement.
- The office is open Monday through Friday, during hours set by Anna Báthory.
- Opening hours are displayed in areas of the office accessible to the clients.
- To the fullest extent permitted by applicable law, Anna Báthory reserves the right to change its opening hours for valid reasons.
- All persons present on the office premises are required to comply with a strict prohibition on smoking and the use of tobacco and nicotine products, including electronic cigarettes, as well as a strict prohibition on the consumption of alcoholic beverages and any other intoxicating or controlled substances.
- Animals are not permitted on the office premises.
- Clients shall be fully liable for any damage to the office’s equipment or furnishings.
COOPERATION. SCHEDULING APPOINTMENTS
- A prospective client may schedule an appointment with Anna Báthory via the ZnanyLekarz online booking system, by email, through the contact form available on Anna Báthory’s website, or by telephone.
- Appointments booked via the ZnanyLekarz platform. To initiate cooperation, including scheduling a consultation through the ZnanyLekarz platform, the prospective client should visit www.znanylekarz.pl, locate Anna Báthory’s profile, and follow the instructions provided on the platform.
- Appointments booked by email or via the contact form. To initiate cooperation, including scheduling a consultation, the prospective client may send an inquiry to the following email address: office@annabathory.pl or use the contact form at https://annabathory.pl/kontakt/. In response, the prospective client will receive detailed information.
- Appointments booked by telephone. To initiate cooperation, including scheduling a consultation, the prospective client may contact Anna Báthory by telephone at +48 501 19 2048. Following the call, the prospective client will be received with detailed information via email.
FEES AND PAYMENT METHODS
- Anna Báthory charges fees in accordance with the price list available at the office and through the ZnanyLekarz system, unless otherwise agreed.
- All fees listed in the price list are in Polish zloty (PLN) and are gross amounts (inclusive of applicable taxes).
- The stated fees apply to a single service, unless otherwise indicated in the price list.
- Payment for services may be made by bank transfer to Anna Báthory’s account or by payment card at the office, in accordance with the payment schedule agreement with the client.
SERVICES
- Anna Báthory provides specialized services, including psychological consultations, psychotherapy, and sexological consultations.
- The services offered by Anna Báthory are exclusively for adults.
- Anna Báthory does not provide psychological services or therapy for couples, marriages, families, children, or persons with disabilities.
- All services are provided by Anna Báthory.
- Services are offered either online or in person at the office.
- A single consultation lasts 45 minutes and takes place within the agreed time slot. The consultation duration cannot be extended. Any delay by the client does not constitute grounds for reducing the applicable fee.
- Individual consultations are scheduled on a case-by-case basis. The appointment selected by the prospective client is confirmed only after payment is credited to Anna Báthory’s account.
- Psychotherapy may begin only after the completion of a consultation phase consisting of one to five sessions.
- Psychotherapy is conducted in therapeutic sessions held at set appointments, agreed-upon time slots, with a frequency determined individually during the consultation phase and the establishment of therapeutic guidelines. Sessions are not held on public holidays or during periods when Anny Báthory is unavailable
- The reservation of standing appointments days and times constitutes the client’s consent to pay for the reserved appointments.
RESCHEDULING AND CANCELLATION
- The rules governing session cancellations and applicable fees are part of the therapeutic framework and are discussed with the client during the initial sessions.
- Anna Báthory and the client agree on standing appointment times for psychotherapy sessions, which are held on a regular basis – typically once per week – within agreed time frames.
- The session fee is due for the reserved time slot, regardless of the client’s attendance.
- The client may cancel up to four (4) sessions per calendar year when attending one (1) session per week, or up to six (6) sessions per calendar year when attending two (2) sessions per week, without charge, provided that notice of cancellation is given at least 48 hours prior to the standing appointment.
- If a standing appointment is canceled in violation of the notice period described in Section 5.4, or after the applicable annual cancellation limit has been exceeded, the session fee shall be payable in full.
- In exceptional and/or unforeseen circumstances, Anna Báthory may, at her discretion, waive the fee for a missed session after individual consultation with the client.
- The client shall not be charged for sessions that do not take place due to reasons attributable to Anny Báthory. In the event of an unplanned or unannounced absence by Anny Báthory, a substitute session will be offered, subject to availability.
CODE OF ETHICS AND CLIENT RECORDS
- All services are provided in accordance with the Psychologists’ Code of Ethics adopted by the Polish Psychologists’ Association.
- When providing services, Anna Báthory is subject to professional confidentiality to the extent required by applicable law. Release from professional confidentiality is permitted solely in cases expressly provided for by law.
- No documentation of therapeutic processes is maintained for the services provided.
- At the client’s request, Anna Báthory may issue a certificate confirming participation in psychotherapy or psychological counseling.

MODIFICATION OF THE PRACTICE POLICY
- The Practice Policy becomes effective as of the date they are made available at the office.
- All agreements are concluded in Polish and are governed by Polish substantive and procedural law. The English version of the Practice Policy is provided for informational purposes only.
- Anny Báthory may unilaterally amend the Practice Policy with respect to provisions not individually agreed with the client, provided there are justified reasons for the amendment. Justified reasons shall include, in particular, changes in generally applicable laws in force in the Republic of Poland, the emergence of judicial or administrative case law, or the issuance of decisions by public administrative authorities.
GOVERNING LAW AND JURISDICTION
- Any and all claims relating to the Practice Policy between:
- Anna Báthory and a client who is a consumer or an entrepreneur entitled to consumer protection rights shall be subject to the jurisdiction of the court competent under the applicable provisions of the Polish Code of Civil Procedure;
- Anna Báthory and a client who is an entrepreneur shall be submitted to the court having jurisdiction over Anna Báthory’s place of residence.
- For the avoidance of doubt, nothing in the Practice Policy shall limit or exclude any rights of a consumer or an entrepreneur afforded consumer protection under the laws in force in the Republic of Poland. In the event that any provision of the Practice Policy is found to have such an effect, the mandatory provisions of applicable law shall prevail.
- If any provision of the Practice Policy is held to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions unless the parties would not have entered into the agreement without that provision, and it is not possible to amend or supplement the Practice Policy in a manner that most closely reflects the parties’ original intent.
- In matters not governed by the Practice Policy , the applicable provisions of Polish law shall apply.
PROVISION APPLICABLE TO CLIENTS RESIDING OUTSIDE OF POLAND
- To the extent that a consumer enters into an agreement with Anna Báthory and has a habitual residence within the European Union, the consumer shall be entitled to the mandatory rights afforded under the laws of the consumer’s country of residence, which cannot be excluded by agreement, pursuant to the law that would be applicable in the absence of a choice of law, based on the consumer’s habitual residence.
- To the extent that a consumer enters into an agreement with Anna Báthory and does not have their habitual residence within the European Union, Anna Báthory declares that Polish law shall apply as the governing law, provided that such choice of law shall not exclude the application of mandatory provisions of the consumer’s habitual residence law, to the extent that such provisions afford a higher level of protection.
- The choice of Polish law as the governing law, as set forth in Sections 10.1 and 10.2, shall not deprive the consumer of the protection afforded by provisions that cannot be excluded by agreement under the law that would apply in the absence of such choice, to the extent that the Practice Policy and the provisions of Polish law provide a lower level of consumer protection than the mandatory provisions of the law of the consumer’s habitual residence.
- To the extent that an agreement is concluded with a client who does not have their habitual residence within the territory of the Republic of Poland, any and all claims relating to the Practice Policy with such agreements shall be resolved in the courts located in the court of the Republic of Poland with subject-matter and territorial jurisdiction, unless the mandatory provisions of the law of the consumer’s habitual residence or mandatory conflict-of-laws rules that cannot be excluded by agreement provide otherwise.
- Sections 10.1-10.4 shall apply accordingly to entities which, similarly to the Republic of Poland, are granted the status of an entrepreneur entitled to consumer protection rights, that is, entities to which, pursuant to the laws of their habitual residence, certain provisions governing consumer rights apply to the extent that such provisions cannot be excluded by agreement.
- To the fullest extent permitted by law, Sections 10.1–10.5 shall not apply to an entrepreneur.
- To the fullest extent permitted by law, in the event of any and all claims relating to the Practice Policy , the prevailing party shall be entitled to recover from the non-prevailing party, and the non-prevailing party shall be obligated to pay, all reasonable attorneys’ fees, court costs, and expenses incurred in connection with the prevailing party’s legal representation.
